A Fairmont man is accused of swinging a metal folding chair at a city worker who asked him to leave a rental shelter at a Fairmont park, then threatening to cut off the worker’s hands and kill him, according to a criminal complaint.

Tucker Jay Schultz, who was 22 at the time of the alleged offense, faces a felony count of making terroristic threats in reckless disregard of the risk of causing terror and two misdemeanor counts of fifth-degree assault. The complaint was filed Oct. 7 in Martin County District Court.

According to the complaint, a City of Fairmont employee was cleaning the rental shelter at Sylvania Park on Lake Sisseton in the early afternoon of Oct. 6 when Schultz walked in. The worker told him the shelter is available only by rental and that he had to leave, and Schultz replied that the shelter was public and he could be there.

The worker told police that Schultz grabbed a metal folding chair and swung it at him. He pushed the chair down and it struck his legs before falling to the floor, the complaint says. Schultz then said he was going to cut the worker’s hands off and kill him.

Schultz later left a voicemail saying the worker “is going to die a very painful death,” according to the complaint. Police listened to the recording.

Schultz also called police himself and reported that the worker had pushed him around. He told officers he had walked into the unlocked shelter and that the worker told him to leave and pushed him out of the building, the complaint says. He had left the park by the time officers spoke with the worker.

The threats count carries a maximum sentence of five years in prison, a $10,000 fine or both, according to the complaint.
