A man fired a rifle into the woods near a Pequot Lakes residence after three juveniles drove by honking a horn, then threatened to shoot out the tire of their vehicle, according to the complaint.

James Allen Rivet, 42, is charged in Crow Wing County District Court with three counts of second-degree assault with a dangerous weapon and one count of threats of violence, in a complaint filed October 6.

According to the complaint, Pequot Lakes police were called at about 6:07 p.m. on October 4 after three juveniles reported that Rivet came out of a detached garage on the property where he was staying, holding a brown and black rifle. The juveniles said they had been driving a side by side around the property and honking the horn when Rivet emerged, told them to stop and called one of them names.

When one of the juveniles asked if Rivet was going to shoot her with the gun, Rivet replied, “Yeah, I will, and I’ll shoot that tire.” The juveniles said Rivet never pointed the gun at them but that they were scared by his actions.

The complaint says the juveniles described the firearm as a brown and black rifle. They reported the incident to a family member, who told police she did not witness what happened but said the juveniles were upset and told her Rivet had come out with a gun. The family member said Rivet later admitted to her that he fired the gun twice to get their attention because they were honking the horn.

Officers spoke with Rivet at the garage, according to the complaint. Rivet told police the juveniles kept honking the horn near the garage and were not listening to him, so he fired a couple of rounds in the opposite direction of the juveniles to get their attention. Rivet admitted to threatening to blow out the tire of the side by side with the gun if he had to, but denied threatening to shoot the juveniles.

He said he fired three times into the woods, away from where the juveniles were standing and described the gun as an AK-style rifle.

Rivet was arrested at the scene and transported to Crow Wing County on felony charges of second-degree assault with a dangerous weapon and threats of violence.
