A woman woke up in her Minneapolis apartment with no memory of how she got there and evidence she had been sexually assaulted during the night.

Jonathan Espinoza Capetillo, 38, of Minneapolis, faces a charge of 3rd-degree criminal sexual conduct for allegedly engaging in sexual penetration with a victim who was mentally impaired.

The incident occurred on November 7, 2025, when the victim went to Rumba Uptown, a nightclub in Minneapolis. After consuming alcohol and dancing, she lost consciousness and later woke up in her apartment on November 8, 2025, with signs of sexual activity and no recollection of the events that transpired. The victim reported feeling “funny” and “off” after drinking, and she found a condom wrapper near her bed, along with bruising and discomfort.

Law enforcement was alerted to the situation when the victim underwent a SANE exam at Regions Hospital. Officers reviewed surveillance footage from the victim’s apartment, which showed her arriving home with Capetillo, appearing unsteady and needing assistance. The footage captured Capetillo throwing something outside the apartment building, which was later identified as a condom.

Capetillo voluntarily spoke with law enforcement, admitting to being at the nightclub and later going to the victim’s apartment, where he claimed they had consensual sex. He stated he used a condom and believed he disposed of it outside. DNA results are pending after he consented to provide a sample.

Capetillo is currently in custody. A court date has not yet been set. If convicted, he faces a maximum penalty of up to 15 years in prison for the charge of 3rd-degree criminal sexual conduct.
