A Bloomington man is charged with criminal sexual conduct after a woman reported she was sexually assaulted while sleeping at his apartment.
The incident occurred on June 4, 2026, at an apartment complex in Bloomington.
Franklin Jhair Veloz Giler, 20, faces a charge of 4th-degree criminal sexual conduct for allegedly touching the victim while she was asleep and unable to consent.

According to the complaint, officers responded to the scene after the victim called police from her boyfriend’s vehicle in the parking lot. She explained that she’d spent the night with her boyfriend and his friend, later identified as Giler and that they’d been drinking alcohol together.
The victim said she fell asleep on an air mattress in the living room and woke up to someone performing oral sex on her. Initially thinking it was her boyfriend, she opened her eyes to find Giler standing next to her, with her pants and socks removed.
Officers arrived at the apartment and found Giler asleep on the same air mattress where another male witness was lying. The witness stated he had fallen asleep next to the victim and was unaware of what had transpired. Giler’s brother, who also lived in the apartment, confirmed that he saw Giler come home with the victim and the other witness.

After being apprehended, Giler initially denied touching the victim but later admitted to removing her pants and touching her while she was asleep. He claimed the victim was not aware of his actions. Giler is currently in custody at the Hennepin County Jail, with conditional bail set at $500,000.
Giler is next due in court on the charges on June 8. If convicted, he faces a maximum penalty of up to ten years in prison for the 4th-degree criminal sexual conduct charge.
