Man Charged After Fatal Saint Paul Apartment Shooting, Crash

A man is charged with murder after a shooting early Sunday inside a Saint Paul apartment left one man dead and another nearly shot as he tried to escape.

According to a newly filed criminal complaint, officers responded to an apartment building on the 700 block of North Victoria Street where officers found a man fatally wounded and a suspect fleeing in a car moments before crashing.

The complaint charges 27-year-old Spencer Curtis McAloney with second degree murder with intent, attempted second degree murder and possessing a firearm as a person prohibited. He is accused of shooting and killing 32-year-old Tarik Hazem Hassan inside the apartment and attempting to shoot a resident who encountered him in the hallway.

Officers were sent to the apartment building at 1:38 a.m. Sunday after multiple 911 callers reported gunfire inside the lower-level unit. One caller reported seeing a male with a handgun running from the scene.

When officers entered the building, they found the apartment door ajar. Inside, they found Hassan lying on the living room floor with multiple gunshot wounds to his torso. Officers moved him off the handgun found beneath him and began CPR, but medics pronounced him dead at 1:52 a.m. The apartment showed signs of heavy drug use, including burned tinfoil, torches and scales, and the bedroom appeared ransacked with an open window and blood around the frame.

Outside, officers spotted a silver Toyota Camry idling with its lights off. As they approached, they heard a loud noise they believed may have been a gunshot. The Camry sped away with no headlights as an officer gave chase for less than two blocks before the Camry sideswiped a parked Cadillac and crashed into another parked car on the 700 block of Englewood Avenue.

The driver matched a description provided by a 911 caller and was identified as McAloney. Officers noted he was bleeding from his mouth, nose and right eye. They found suspected drugs in his pocket, an empty gun holster on his waistband and a Glock-style handgun in the driver’s footwell. The gun was missing a magazine. A cellphone was found near the gun.

Investigators found a live round on the stairs leading to the upper level and a spent casing and empty magazine near a fire door. Inside the apartment, they located drug paraphernalia and signs that people had fled through the bedroom window, leaving blood on the floor and window frame.

One woman who had been inside the apartment earlier that night told investigators the place had been crowded with more than ten people using drugs. She said McAloney appeared paranoid, saying people were after him and accusing the victim of setting him up. Hassan repeatedly tried to calm him, but witnesses said McAloney pointed a gun at people moments before firing several rounds. Several people escaped by climbing out the bedroom window.

A resident who lives in another unit told investigators he heard 8 to 10 gunshots and saw the suspect leave the apartment and a man lying on the floor. When the resident went upstairs to his own apartment, the suspect confronted him, pointed a gun at his chest and pulled the trigger. The gun did not fire. The resident’s girlfriend opened their door, allowing him to slip inside as the suspect hit the door and yelled for it to be opened.

The Ramsey County Medical Examiner determined Hassan died of multiple gunshot wounds and ruled the death a homicide.

The complaint states McAloney has prior felony convictions for aggravated robbery, possessing ammunition as a prohibited person and drug possession, making him ineligible to have a firearm or ammunition. A warrant had also been issued for his arrest in September after he failed to appear for sentencing in relation to a drug charge in Dakota County.

A judge ordered McAloney held on $1.5 million bail. If convicted of the top charge, he faces up to 40 years in prison. He is expected to make an initial court appearance on Tuesday.
