CHARGES: Burrito Bowl Theft Leads to Gunfire at Uptown Chipotle

A man is accused of pulling a gun on a Chipotle worker in Minneapolis after walking out without paying for his food.

Prosecutors charged 32-year-old Cody John Schwendeman with first-degree aggravated robbery for the June 28 incident at the Chipotle located at 2600 Hennepin Avenue.

Police say Schwendeman entered the restaurant around 4:40 p.m. and left with a burrito bowl without paying. An employee confronted him in the parking lot and asked him to return the food if he was not going to pay. Schwendeman allegedly pulled out a rusty revolver and fired a shot toward the employee, who was not hit. He then fled in a Hyundai Elantra, still holding the food.

Officers reviewed security footage, which reportedly showed the confrontation and helped them identify Schwendeman. Investigators used an enhanced image from the video to confirm his identity. The criminal complaint stated he was already wanted in Hennepin County on a felony fleeing case.

Court records show Schwendeman has a lengthy criminal history, including multiple robbery, burglary, and drug convictions across several counties. He was convicted of second-degree aggravated robbery in Hennepin County in 2022 and financial transaction card fraud in 2024. He has also been convicted of fleeing police, forgery, and firearms violations dating back more than a decade.

Records indicate Schwendeman was released from prison on May 20, 2025, following his sentence for the 2022 robbery case. Just over a month later, he is accused in the Chipotle gunfire incident that led to the current aggravated robbery charge.

He remains in custody in another county while a warrant has been issued in the robbery case.

If convicted of first-degree aggravated robbery, Schwendeman faces up to 20 years in prison and a $35,000 fine.
