CBP Agent Charged with DWI After Saint Paul Arrest

A U.S. Customs and Border Protection agent is facing charges after a state trooper arrested him for driving while intoxicated in Saint Paul.

The federal agent was allegedly found slumped over the wheel of his vehicle and covered in vomit early Tuesday morning.

Alfredo Mancillas Jr., 31, of Corpus Christi, Tex., is charged with one count of third-degree DWI for refusing to submit to a breath test and one count of fourth-degree DWI for operating a motor vehicle under the influence of alcohol.

According to the criminal complaint, a trooper with the Minnesota State Patrol was patrolling near Saint Anthony Avenue & Simpson Street in Saint Paul at around 3:25 a.m. on Jan. 27 when the trooper observed a vehicle pulled over on the right side of the road. The vehicle was stopped directly in front of a "No Parking" sign.

 

Upon approaching the vehicle, the trooper observed the driver, later identified as Mancillas, slumped over in the driver's seat. The complaint states the trooper noted a strong odor of alcohol coming from Mancillas and observed that his eyes were bloodshot and watery. The trooper administered standardized field sobriety tests on the scene and noted several signs of impairment. Mancillas was subsequently placed under arrest.

Following the arrest, the trooper read the Minnesota breath testing advisory to Mancillas and requested a breath sample for testing. Prosecutors say Mancillas refused to provide the sample.

Mancillas was identified as an agent with U.S. Customs and Border Protection and when reached for comment regarding the charges against the agent, a spokesperson provided a statement emphasizing their standards of conduct:

“CBP stresses honor and integrity in every aspect of our mission, and the overwhelming majority of CBP employees and officers perform their duties with honor and distinction, working tirelessly every day to keep our country safe,” a Customs and Border Protection spokesperson said.

Mancillas made an initial court appearance and was released from custody on his own recognizance. The third-degree DWI charge carries a maximum sentence of 364 days in jail while the fourth-degree charge has a maximum sentence of 90 days in jail. His next court appearance is set for March 24.
