A Saint Paul man grabbed a woman inappropriately after first touching her in front of others during a night of drinking at his home.

David Ernesto Guevara-Hernandez, 30, faces two charges: 4th-degree criminal sexual conduct and 5th-degree criminal sexual conduct for nonconsensual sexual contact, according to a complaint filed Wednesday in Ramsey County District Court.

According to the complaint, officers responded to a sexual assault report in the early morning hours of July 5, 2025. When they arrived, they found Guevara-Hernandez and a woman he was in a romantic relationship with, who told police that the person who called 911 had already left. She explained that her friend had been visiting at their home, and that all three adults had been drinking together.

The woman told officers she went to take a shower. When she returned, the victim reported that Guevara-Hernandez had walked by her in the hallway and grabbed her butt. At first, the victim did not react, but later, while she was holding one of the children, Guevara-Hernandez walked up to her, put his hand down her shirt and sexually assaulted her. The victim said she told him “un no” and pushed him away. Guevara-Hernandez apologized, according to the complaint.

The victim then called the victim, who is also the woman’s brother. He told police he rushed over to the house and, upon entering, saw Guevara-Hernandez run to the bathroom and lock the door. The boyfriend said he was not there to fight but wanted to talk about what happened. When he confronted Guevara-Hernandez, Guevara-Hernandez claimed he did not remember the events.

During a later interview on March 31, 2026, Guevara-Hernandez told investigators he had drunk more than he should have that night and denied touching the victim. He said both the woman and the victim confronted him about the incident and that the woman pushed him before police were called. The woman also spoke with investigators and expressed support for Guevara-Hernandez, adding that she and the victim were no longer friends.

The charges allege that Guevara-Hernandez engaged in nonconsensual sexual contact by inappropriately touching the victim without her consent.

The charge was filed June 24, 2026. A court date has not yet been set.
