The victim in the complaint, stated that he had previously encountered Rushing outside a liquor store earlier that day. After seeing Rushing, DDC felt threatened and left the store to wait in a vehicle with a friend. Shortly after, an SUV pulled up next to them and DDC recognized Rushing in the front passenger seat. Fearing for his safety, DDC exited the vehicle and ducked down as Rushing allegedly fired several shots at him and his friend’s vehicle before fleeing the scene.
