Understanding Sexual Violence
Criminal Sexual Conduct - 1st Degree
The most serious sexual assault charge in Minnesota. Involves allegations of sexual penetration under circumstances such as force, threat of harm, or when the victim is under 13.
Max penalty: Up to 30 years in prison and/or $40,000 fineMinn. Stat. § 609.342
Criminal Sexual Conduct - 2nd Degree
Involves allegations of sexual contact (not penetration) under aggravating circumstances such as force or when the victim is a young minor.
Max penalty: Up to 25 years in prison and/or $35,000 fineMinn. Stat. § 609.343
Criminal Sexual Conduct - 3rd Degree
Involves allegations of sexual penetration in circumstances the law lists. They include a victim who is 14 or 15 and an actor more than two years older; a victim under 14 and an actor no more than three years older; force or coercion; and an actor more than three years older in a position of authority over a victim who is 16 or 17.
Max penalty: Up to 15 years in prison and/or $30,000 fine (all other cases); up to 5 years and/or $30,000 (a complainant aged 14 or 15 and an actor no more than three years older)Minn. Stat. § 609.344
Criminal Sexual Conduct - 4th Degree
Involves allegations of sexual contact (not penetration) under circumstances involving a minor or abuse of authority.

Criminal Sexual Conduct - 5th Degree
Involves allegations of non-consensual sexual contact or conduct, generally a less severe classification than higher degrees.
Max penalty: Up to 7 years in prison and/or $14,000 fine (felony, a repeat offense within ten years); up to 2 years in prison and/or $10,000 (felony, nonconsensual sexual penetration); up to 364 days in jail and/or $3,000 (gross misdemeanor, nonconsensual sexual contact)Minn. Stat. § 609.3451
Labor Trafficking
Allegations of labor trafficking: recruiting, transporting, transferring, harboring, enticing, providing, obtaining or receiving a person in furtherance of debt bondage; forced or coerced labor or services; slavery or practices similar to slavery; or the removal of organs through coercion or intimidation; or receiving profit while knowing or having reason to know it comes from such an act.
Max penalty: Up to 25 years in prison and/or $40,000 fine (trafficking that results in death); up to 20 years and/or $40,000 (a victim under 18, an extended period, or great bodily harm); up to 15 years and/or $30,000Minn. Stat. § 609.282
Sex Trafficking
Allegations that a person, acting other than as a prostitute or patron, intentionally did one of the following: solicited or induced someone to practice prostitution; promoted prostitution; received profit knowing or having reason to know it came from prostitution; or engaged in sex trafficking, defined as receiving, recruiting, enticing, harboring, providing or obtaining a person to aid in that person's prostitution, or receiving profit from doing so. First degree applies when the individual involved is under 18. A listed aggravating factor raises the maximum in either degree.
Max penalty: Up to 30 years in prison and/or $60,000 fine (first or second degree with an aggravating factor); up to 25 years and/or $50,000 (first degree, a victim under 18); up to 20 years and/or $40,000 (second degree)Minn. Stat. § 609.322
