On January 1, 2026, at 8:51 P.M., Apple Valley police officers responded to a report of a shoplifting in progress at a business in the City of Apple Valley, Dakota County, Minnesota. When they arrived, they met the Loss Prevention Officer outside the store. Shortly thereafter Khamphythoun Tom Phalavong, defendant herein, left the store with the unpaid for merchandise. The loss prevention officer stopped the defendant and walked him back inside the store’s Loss Prevention Office with the officers.
The loss prevention officer was familiar with the defendant from when he shoplifted $55.47 worth of items from the store on October 23, 2025. On January 1, 2026, the defendant had stolen items with a value less than $500.00. The officers searched the defendant incident to arrest. They located a plastic bag containing a tan- colored powder substance on the defendant. The substance was later preliminarily tested, and the test indicated the presence of methamphetamine and it weighed 1.06 grams.
