On January 17, 2026, officers were dispatched to a business located on Nicollet Blvd. E. In Burnsville, Dakota County, Minnesota, on report of a male inside the business bathroom refusing to come out. The reporting party advised the male was acting belligerent and had locked himself in the bathroom stall. The reporting party, who was a security guard for the business, advised that they had asked the male to leave numerous times and the male cussed at them in response. Officers arrived at the business and made contact with the male, who was inside the business, sitting in a chair near the main entrance.
Officers attempted to speak with the male with reference to the trespass issue. The male immediately got up out of the chair and began to walk away from the officers. The male was walking further into the business. Officer attempted to stop the male by grabbing his arms and asking him to speak with them. The male refused to sit back down and tried to break free from the officers’ control. The male continued to struggle with the officers and the officers advised the male he was under arrest. During a search incident to arrest, the male refused to listen to commands from the officers and was pulling away from the officers who were trying to hold him still.
The male was kicking his legs back at the officers. To get better control of the male, officers assisted the male to the ground without incident. While on the ground, the male continued to move and flail to get away from the officers. The male then intentionally spit a large amount of saliva at the officers, which landed on the arm and leg of the officer directly in front of him. The male continued to kick and flail on the ground. The male had to be placed in a wrap device to be transported by officers.
