On April 18, 2026, officers with the Burnsville Police Department were dispatched to the Carbone’s restaurant on Harriet Avenue S in the city of Burnsville, which is within Dakota County on a weapons report. At the scene officers made contact with C. X. L. A., an adult man fully identified in police reports, hereinafter “Victim.” Victim reported to the officers he had been at the restaurant with R. S. D., an adult woman fully identified in police reports, when a man, identified as Joseph Francisco Delvalle [DOB REDACTED], hereinafter “Defendant,” entered the restaurant and began “digging into” Victim’s box of pizza.
Victim reported that he confronted Defendant about this, at which time Victim pulled a knife out of his pocket, opened it, and stabbed it into the tabletop. Defendant then told Victim, “I’ll f*** you up,” while holding the knife into the table. Defendant then left the restaurant. Another restaurant patron indicated that Defendant had threatened to retrieve an AR-15 from his vehicle while arguing with Victim. He further indicated that Defendant appeared intoxicated. Victim indicated that he believed Defendant was capable of harming him and was afraid to leave the restaurant out of fear that Defendant would be waiting for him to leave.
Defendant was located and apprehended by law enforcement nearby. After Defendant had been detained officers conducted a “show up,” with Victim and R. S. D., who both confirmed that Defendant was the one who had threatened Victim. A CAT-branded black and yellow folding knife was located on Defendant’s person. Defendant was transported to the Dakota County Jail.
