Ryan James Smith

On January 10, 2026, at approximately 1:36 A.M., Brainerd Police Officer Bryce Johnson was on patrol in Brainerd, Crow Wing County, Minnesota when he observed a vehicle bearing license plate [PLATE REDACTED] whose registered owner had a revoked driving status. Officer Johnson stopped the vehicle which was driven by the registered owner, Ryan James Smith [DOB REDACTED], hereinafter "defendant," and confirmed that defendant's driving status was still revoked. Officer Johnson was aware that defendant had been arrested for two prior controlled substance DWIs within the past three months.

Officer Johnson observed defendant exhibited fidgety movements with his hands, had dilated pupils and bloodshot and watery eyes. Officer Johnson, a certified Drug Recognition Evaluator, recognized these observations as indicators of impairment. Defendant cooperated with field sobriety testing and displayed indicators of controlled of impairment. Defendant was arrested for DWI. Officer Johnson applied for and was granted a search warrant for a sample of defendant's blood or urine. The officer explained the search warrant and that refusal to test was a crime.

Defendant was asked several times to test and he refused to provide a sample. Defendant has three qualified prior impaired driving incidents within ten years of the current offense: -Impaired driving related loss of license on 12/19/25 for driving conduct occurring on 11/2/25 (court file number ••-CR-••-••••); -Impaired driving related loss of license on 12/29/25 for driving conduct occurring on 11/9/25 (court file number ••-CR-••-••••); -Convicted if DWI on 6/6/24 for driving conduct occurring on 9/22/23 (court file number ••-CR-••-••••).
