On January 7, 2026, an officer was on patrol when he saw a gas station employee run out of the gas station, chasing a male on foot. The male continued to run, but the female slowed to a stop and the officer spoke briefly to her. The employee told the officer that the male had just stolen property from the store. The officer aired the male’s description, and a second officer located him in the backyard of a nearby residence. The officer exited his squad car, and asked the male, later identified as AUSTIN DANIEL HOGAN [DOB REDACTED], to come to him.
HOGAN did not comply with the officer’s instructions. The officer continued to approach HOGAN on foot and saw that HOGAN was digging in his waistband area, which concerned the officer that he may have a weapon. HOGAN would not comply with the officer’s commands to remove his hands from his pockets. The officer removed his handgun, at which point HOGAN stated, “I’ll shoot. I have a gun. I will shoot.” HOGAN was moving erratically while saying this. HOGAN then moved toward the officer with his hands in his pockets stating, “I’m not joking, man.
I’m not joking.” The officer took cover in the backyard, believing he was in danger. While the officer backed up, HOGAN started counting down from five and told the officer not to move another step. Another officer arrived on scene to assist and attempted to tase HOGAN but was unsuccessful. The officer then tackled HOGAN, and both officers were able to secure him into handcuffs. Officers observed that HOGAN appeared intoxicated and also showed signs consistent with drug use.
