On December 8, 2025, at 8:48 P.M., Eagan police officers responded to a report of an individual, later identified as the above-named defendant, David Richard Dhaene Jr., slumped over in his motor vehicle in a business parking lot in the City of Eagan, Dakota County, Minnesota. When the officers arrived, they observed the defendant asleep in the driver’s seat of the vehicle with the engine running. The defendant and lone occupant of the vehicle did not wake up when the officers knocked on the vehicle’s window.
The officers then shut the vehicle off and unbuckled the defendant’s seat belt and he woke up. The defendant was checked out by medics who determined his blood pressure was high. The officers noticed the defendant’s pupils were dilated and slow to react to light. The officer had the defendant perform some field sobriety tests, some of which he passed and some of which he failed, after which the defendant was placed under arrest. A search warrant was obtained, and a sample of the defendant’s blood was taken for testing at the Minnesota Bureau of Criminal Apprehension.
The results of the test indicated the presence of fentanyl and norfentanyl. Fentanyl is a Schedule II controlled substance. In the defendant’s right pants pocket was a bindle containing several pills. There were 10 whole pills and 2 halved pills. The pills were identified on a drug identification web site as containing Acetaminophen and Oxycodone Hydrochloride, a Schedule II controlled substance.
