On January 19, 2026, at approximately 8:47 P.M., Breezy Point Officer Rustad was monitoring traffic near the intersection of Sunset Valley Road and Upper Cullen Road in Pelican Township, Crow Wing County, State of Minnesota. Officer Rustad observed a vehicle pass by him with no front license plate, no front bumper and an inoperable headlamp. Officer Rustad began to prepare to stop the vehicle and observed it fail to stop at a 4-way intersection. Officer Rustad activated the lights on his squad and stopped the vehicle and identified the driver as Robert Joseph Hamann, [DOB REDACTED], hereinafter defendant.
The defendant's driving status was revoked. Officer Rustad observed the defendant's pupils were dilated, he had sunken cheeks with gaunt facial features and there was involuntary clenching of his cheeks and jaw. Officer Rustad suspected the defendant may be under the influence of a controlled substance. The defendant was placed under arrest for suspicion of DWI and driving after revocation. Officer Rustad and Officer Salvevold conducted an inventory search of the defendant's vehicle and located a case which contained a small plastic baggie with a white crystal substance inside.
The white crystal substance weighed approximately one gram and field tested positive for methamphetamine which is a schedule II controlled substance. Officer Rustad obtained a search warrant for a urine sample which was taken at 9:46 P.M. And sent to the MN BCA for analysis. The defendant has a prior conviction for DWI from May 4, 2023, on file ••-CR-••-••••. The defendant has an implied consent violation on his record from September 11, 2025.
