On October 14, 2025, at approximately 10:40 P.M., a police officer was on routine patrol in Mendota Heights, Dakota County, Minnesota. The police officer located a vehicle in a park. It was later determined that the vehicle was parked on top of a large landscaping rock. The police officer spoke with the driver who was identified as JOHN HOWARD CARTER JR. ([DOB REDACTED]). CARTER appeared disoriented, smelled of alcohol, had slurred speech, and had glossy eyes. CARTER claimed his last alcoholic beverage was a few days prior.
CARTER claimed that he was not aware he was parked on a rock. CARTER complied with standard field sobriety tests. During the horizontal nystagmus test, CARTER showed clues of impairment. During the walk-and-turn test, CARTER showed clues of impairment. During the one-leg-stand test, CARTER showed clues of impairment. A preliminary breath test showed a result of 0.245 BAC. CARTER was arrested for driving while impaired. At the police department, a police officer read the Minnesota Breath Test Advisory to CARTER. CARTER was provided with time and resources to contact an attorney.
CARTER agreed to comply with the DMT breath test. The breath test showed a result of 0.22 BAC. CARTER has a prior felony-level conviction for DWI on May 30, 2018 (court file no.: 19HA-CR-18-68).
