On January 27, 2026, at approximately 3:08 AM, law enforcement was dispatched to an address on College Avenue South, in the city of St. Joseph, county of Stearns, state of Minnesota, on a report of a sexual assault. Law enforcement arrived and spoke with Victim A, an adult female fully identified in reports. Victim A reported that she was sleeping and woke up to Brian Muinde Kimithi, [DOB REDACTED], the defendant herein, vaginally penetrating her with his penis. Victim A reported that she tried to push the defendant away, told the defendant to stop, and tried to yell for help.
Victim A reported that the defendant grabbed her throat and began strangling her with one hand. Victim A reported the defendant was pushing down with full force on her neck. Victim A reported having difficulty breathing while being strangled. Victim A reported that the defendant continued to vaginally penetrate her with his penis for another two to three minutes. Victim A reported the defendant stopped and she left the room and reported the assault to Witness A, an adult female fully identified in reports, who called law enforcement.
Victim A reported that she had pain in her throat and difficulty swallowing. Law enforcement observed and photographed scratches and bruising to Victim A's neck and scratches to her chest, stomach, and shoulder. The defendant was located and placed under arrest. In a Mirandized statement, the defendant admitted to vaginally penetrating Victim A with his penis. Complainant has reason to believe and does believe that all of the above information is true and correct. The above facts constitute your complainant's basis for believing that the above-named defendant, on or about the 27th day of January, 2026, in the city of St. Joseph, County of Stearns, State of Minnesota, committed the offense(s) described herein.
