Your Complainant, on behalf of the New Hope Police Department, upon investigation and information states that on October 24, 2025, at 7:21 P.M., New Hope Police Officers were dispatched to HyVee located at 8200 42nd Ave North, City of New Hope, County of Hennepin, State of Minnesota on a report of a suspected DWI. Dispatch stated a male exited the liquor store wobbling while walking, slurring his words and is now sitting in the driver’s seat of a white Ford F150 (MN license plate [PLATE REDACTED]). Upon arrival, officers observed the Ford matching the description given by dispatch in the HyVee parking lot with the engine running.
The driver and sole occupant was identified as Anthony John Dockter [DOB REDACTED] hereinafter known as the defendant. While speaking with the defendant, officers observed him having bloodshot, watery eyes, slurring his words, and the strong odor of an alcoholic beverage emitting from the defendant’s person. The defendant admitted to having one shot about 15 minutes prior to driving to the liquor store. The defendant was asked to perform Field Sobriety Tests (FST) in which the defendant agreed to perform.
When the defendant opened the car door, an unopened alcohol shooter bottle fell from the driver’s seat onto the running board as the defendant exited the vehicle. During the horizontal gaze test, officers observed the defendant lacked a smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation and an onset prior to 45 degrees in both eyes. Officers explained the directions to the walk and turn test and observed the defendant begin the test prior to being instructed to, step off the line, fail to touch heel to toe, and make an improper turn.
Officers observed the defendant put his foot down and failed to maintain his balance while performing the one leg stand test. The defendant was asked to take a preliminary breath test (PBT) but refused stating he would prefer to “just get a ride and not get a DWI.” At this time, the defendant was arrested on suspicion of driving under the influence and transported to the New Hope Police Department for booking. The defendant was read his implied consent advisory and agreed to take a breath test. The defendant had a failure reading of.15 BAC at 8:25 P.M. The defendant has a prior DWI conviction under court file under ••-CR-••-•••• on April 24, 2025.
