Complainant is Minnesota State Patrol Trooper Alejandro Dominguez. Complainant states that on June 22, 2025, at approximately 4:10pm, troopers responded to a motor vehicle roll-over in the area of I-94 & I-494 in the city of Maple Grove, Hennepin County, Minnesota. Upon arrival, troopers observed a silver Nissan SUV in the ditch positioned against a light post. Maple Grove Police Department officers were on scene speaking with the driver of the vehicle, identified as FRANCO PATRICIO GUALANSACA [DOB REDACTED]. When making contact with GUALANSACA, troopers detected a moderate odor of alcohol coming from his person.
GUALANSACA did not speak English, so a language line was used to interpret conversations. Troopers observed GUALANSACA had bloodshot eyes, but he denied consuming alcohol. Due to the crash, observable indicators of impairment, and odor of alcohol, troopers requested GUALANSACA to participate in Standardized Field Sobriety Tests (SFSTs). After requesting GUALANSACA to do SFSTs, troopers again asked when his last drink was, to which GUALANSACA replied he had two beers at midnight the previous night.
During HGN, GUALANSACA displayed lack of smooth pursuit in both eyes. HGN was unable to be fully completed due to GUALANSACA being unable to follow instructions. Due to GUALANSACA not being able to follow simple instructions, troopers asked GUALANSACA to provide a PBT sample. GUALANSACA provided a PBT sample of.228 BAC. GUALANSACA was placed under arrest and transported to the North Memorial Hospital. Troopers obtained a search warrant for blood or urine, and advised GUALANSACA of the warrant and consequence for refusal.
GUALANSACA provided a blood sample. The BCA toxicology report revealed an ethyl alcohol concentration of.179 +/-.010 grams per 100 milliliters of blood with a 99.73% level of confidence. The blood sample was taken at 7:26pm, outside the two hours of driving conduct.
