On November 28, 2024, at Minnesota Correctional Facility- Faribault (MCF-Faribault), Corrections Officers were directed to K3-A Unit to have Incarcerated Person (IP) Luis Gerardo Salazar [DOB REDACTED] (hereinafter Defendant) brought to Segregation per the Watch Commander. A Corrections Officer (CO) instructed the defendant to give him his ID. The defendant took out his ID and threw it at CO, hitting him in the chest. The CO activated the Incident Command System (ICS). At that time, the defendant “squared up” with multiple COs as if preparing to fight.
The defendant was given multiple directives by the COs to get on the ground. The defendant continued to refuse to get on the ground. COs then deployed chemical irritant to gain compliance. The defendant continued to refuse orders and directives from multiple COs. Two COs then attempted to assist the defendant to the ground to gain compliance. CO-1 tried to grab the defendant’s legs while CO-2 tried to control the defendant’s upper half. As they went to the ground, CO-1 lost his grip on the defendant.
The defendant started to throw closed fist punches and hit CO-1 several times on the right and left sides of his face. CO-2 also received a closed fist punch, from the defendant, to the left side of his face, near his eye. Multiple additional COs were responded and were needed to gain control of the defendant in order to transport him to segregation. CO-1 was seen at Allina Health in Faribault. He was diagnosed with having a head injury from the altercation. CO-2 was seen at Allina Health in Faribault.
He was diagnosed with having a “closed head injury, abrasion of face, and injury due to physical assault.” PLEASE TAKE NOTICE: Pursuant to Minn. Stat. 609.49., intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
