The Complainant having reviewed the applicable reports believes the following facts to be true: On or about August 21, 2025, at approximately 2130 hours in the City of Saint Paul, Ramsey County, an officer with Saint Paul Police Department observed a vehicle driving in front him make a turn onto oncoming traffic at a red light at university avenue. The vehicle drove north in the southbound lane for several hundred feet before turning left into the parking lot behind [ADDRESS REDACTED] w. The officer activated his siren and light to stop the vehicle (MN plate # [PLATE REDACTED]). The vehicle continued to a parking spot, and the driver, who was identified as Jimmy Cuong Nguyen, [DOB REDACTED], DL #A551060974211, Defendant herein, exited the vehicle and started to walk towards the building.
During the interactions, the officer observed bloodshot and watery eyes, and a strong odor of consumed alcoholic beverage emitting from him. Defendant did poorly on standard field sobriety tests, and the result of the preliminary breath test was 0.12 so, he was placed under arrest and transported to Ramsey County jail for testing. Defendant was read the breath test advisory. He stated he understood and agreed to take a breath test. However, despite clear instructions being given to him multiple times, Defendant would not blow properly into the testing machine, resulting in insufficient air and the machine shutting down.
Defendant was given more than one chance, but continued to try to defeat the test, ad his behavior was eventually deemed a refusal to test.
