Complainant is Minnesota State Patrol Trooper Garrett Erickson. Complainant states that on June 22, 2025, at approximately 4:23pm, troopers were sitting stationary on the left-hand shoulder due to a rollover crash at the loaction of NB I-494 and I-694 in the city of Maple Grove, Hennepin County, Minnesota. Officers from the Maple Grove Police Department had put flares out onto the roadway directly behind troopers patrol vehicle in an attempt to get traffic to move to the right lane for tooper/officer safety.
Troopers were in their vehicle when they observed a SUV run over all the flares that were placed in the left and and then nearly strike troopers patrol vehicle while failing to move over for the multiple law enforcement vehicles that were parked on the shoulder with their emergency lights activated. Troopers conducted a traffic stop on the vehicle for these violations. Upon contact with the driver, later identified as CORY JOHN RADTKE [DOB REDACTED], troopers immediately were able to detect a strong odor of alcoholic beverage.
Troopers advised the reason for the stop and RADTKE stated he ran the flares over because they were in the left lane and in a curve. While speaking with RADTKE, troopers also observed he had slow motor movements. When asked how long ago his last alcoholic beverage was, RADTKE stated, "not today, yesterday." Troopers asked RADTKE to exit the vehicle and when speaking with him troopers continued to smell the strong odor of alcohol coming from his person. Troopers requested RADTKE participate in Standardized Field Sobriety Tests (SFSTs). During HGN, troopers observed lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, onset of nystagmus prior to 45 degrees, and vertical nystagmus in both of RADTKE's eyes.
While administering HGN, troopers also observed RADTKE was swaying in each direction and was unsteady with his balance. During the walk and turn test, RADTKE lost balance during the instructional phase, started the test prior to the instructions being completed, did not touch heel to toe as instructed, stepped off the line, used his arms for balance, and did not complete a proper turn as instructed. During the one leg stand, RADTKE swayed while balancing, used his arms for balance, and put his foot down.
Troopers again asked about consuming alcohol and RADTKE mentioned the PBT and stated, "obviously we're gonna find out right now." RADTKE then admitted he had some drinks previously, and when asked how many he stated, "enough." RADTKE also stated, "I should probably not be doing this." The PBT was not able to be administered due to significant wind interference until after he was placed under arrest and put in the squad car. Once in the squad car, RADTKE provided a PBT sample of.231 BAC. RADTKE was transported to the Hennepin County Jail where he was read a Breath Test Advisory.
