Probable Cause
On March 17, 2026, at 10:33 P.M., Cottage Grove Police Officer was on patrol and responded to a complaint of a vehicle that had been parked with its lights on in Meadow Grass Avenue in the city of Cottage Grove, Washington County, Minnesota. Officer responded to the area and saw a parked and running S. U. V. There was a sole occupant in the vehicle later identified as Robert Gene Munson, [DOB REDACTED], Defendant herein. Defendant appeared to be passed out in a reclined driver's seat. Defendant appeared confused and disoriented and smelled strongly of consumed alcoholic beverage.
Defendant denied having anything to drink. Defendant agreed to step out of the vehicle to perform standard field sobriety tests. Defendant pushed off the ignition button before exiting the S. U. V. A check of Defendant's driving record revealed that his driving status was DAC-IPS. Officer explained the horizontal gaze nystagmus test. Defendant had lack of smooth pursuit in both eyes, distinct and sustained nystagmus at maximum deviation in both eyes and nystagmus prior to 45 degrees in both eyes.
Defendant displayed 6 of 6 clues. Defendant said he did not want to perform any other tests and declined taking a PBT. Defendant was arrested at 10:50 P.M. And transported to the Cottage Grove Police Department. Defendant was then read the breath test advisory. Defendant declined to take a breath test. Defendant has the following alcohol related driving convictions: 1. DWI related conviction on 11-12-2021 in Georgia 2. DWI conviction on 4-21-2022 in Tennessee 3. Gross misdemeanor DWI on 8-7-2025 in 82-CR-25-2641 4. DWI conviction on 11-12-2025 in Georgia Defendant is in custody.
