The defendant was irritated with the evaluator. The defendant eyes appeared normal at the beginning of testing, but as the testing went on, he became more droopy. After the HGN test, the defendant refused any further testing. Based on the DRE’s evaluation, the defendant appeared to be under the influence of a CNS stimulant and a narcotic analgesic. Deputy Reasoner obtained a search warrant for the defendant’s blood or urine and informed that refusal to provide a sample was a crime. The defendant stated that he would not provide a sample.
The defendant was transported to the Sherburne County Jail. Deputy Reasoner field tested the pipe. It tested positively for methamphetamine. The methamphetamine weighed.05 grams without packaging. The marijuana weighed.77 grams without packaging. The defendant has a prior first degree DWI out of Wisconsin from 2023. The defendant has a number of other driving under the influence convictions from out of state, including a driving under the influence from Colorado in 2017, from Wisconsin in 2011 and 2009, 2008, and 2007.
