M., Sherburne County Deputy Mitchel Reasoner, was at 750 15th Avenue SE, in the city of St. Cloud, Sherburne County, Minnesota, observing traffic, when he observed a blue 2007 Cadillac, bearing MN Lic HGH374. The vehicle’s rear license plate light was dangling in front of the plate which obstructed the license plate. Additionally, the registered owner, Jason Bradley Klinkhammer, [DOB redacted], hereinafter referred to as the defendant, has a revoked driver’s license. The defendant pulled into Kwik Trip, put fuel in his vehicle, and waited for an extended period of time before leaving.
Deputy Reasoner followed the vehicle out of Kwik Trip. The defendant stopped at the stop sign but then turned onto 15th Avenue SE without activating its signal. When Deputy Reasoner pulled closer to the defendant, he saw the defendant with a phone in his hand, being very animated with his arms and made exaggerated movements. Deputy Reasoner activated his emergency lights to initiate a traffic stop. The defendant abruptly signaled a turn to travel westbound on Lincoln Avenue SE. The vehicle swerved back and forth and drove up onto the sidewalk to pull over.
Deputy Reasoner approached the vehicle and spoke with the defendant. The defendant apologized, said that he was hungry and he was working on getting his license back. He was identified by Minnesota ID as the defendant. The defendant’s speech was rapid and appeared to be very talkative. He said that he believed his license was revoked from a DUI in 2011, had recently been pulled over, and only got a warning. Deputy Reasoner noticed that the defendant’s right leg was restless. Deputy Reasoner requested that the defendant perform field sobriety tests.
The defendant said that he had a bad knee and was having a knee replacement in two days and had back issues. Deputy Reasoner asked the defendant to exit the vehicle. When he patted down the defendant for weapons, the defendant said that he had a pill bottle and was on a lot of medication. He also stated that there was marijuana in the pill bottle. The defendant admitted to consuming marijuana earlier in the day. When the defendant performed the Modified Rhomberg Test, the defendant showed eyelid tremors, eyelid flutters, swaying back and forth, he failed the finger to nose test.
Deputy Reasoner determined that the defendant was under the influence of a controlled substance. The defendant was placed under arrest for driving under the influence. Deputy Reasoner performed an inventory search. There was a bubble pipe in the center console with burnt residue and a white chunk of what appeared to be methamphetamine. The defendant was transported to the St. Cloud Police Department in order to perform tests by a Drug Recognition Evaluator. St. Cloud Officer Nathan Vossen performed the drug recognition evaluation.
