M., a Winona County Sheriff’s Deputy was dispatched to the Winona County Detention Center regarding an assault of a corrections officer (Victim). Dispatch informed Deputy that Victim had been punched several times by an inmate, Andrew Curtis Montgomery, [DOB REDACTED] (Defendant). Deputy went to the jail and spoke to Victim. Victim [NAME REDACTED] was doing well checks and delivering breakfast to Defendant’s cell. Victim [NAME REDACTED] was upset because breakfast was being delivered too early. Victim informed Deputy that Defendant seemed agitated and then wanted to speak to a supervisor regarding this issue.
Defendant then started referring to Victim as “Foo,” slang word meaning fool. Because of Defendant’s agitation, Victim activated his body worn camera and positioned himself near the threshold of the cell that Defendant was in to try to de- escalate the situation. While doing this, Defendant struck Victim’s left eye with a closed right-hand fist knocking Victim’s glasses off. Defendant then delivered several more punches to Victim’s chest and back. Victim sustained scratches below his left eye, a small burst blood vessel inside the white portion of his eye, and a small cut on his nose and inside his upper lip.
Victim complained about general soreness to his head and neck. Victim also reported the lenses of his glasses were scratched because of them falling to the ground. Deputy spoke to Defendant after reading him his rights. Defendant stated he did not want to talk about the assault. After talking with Defendant, Deputy reviewed several recordings of the event. The video shows Defendant punching Victim [NAME REDACTED] at the threshold of the cell block as Victim was backing out of it. PLEASE TAKE NOTICE: Pursuant to Minn.
