On July 7, 2025, at approximately 2:44 P.M., while in the City of Duluth, St. Louis County, State of Minnesota, Duluth Police Officer McKee was dispatched to the area of S 23rd Ave W and W Superior St, for a report of an intoxicated male that was sitting in a vehicle. Information from dispatch stated the bartender from Bergey’s Bar called to report that a male named “Mark Bennett” came into the bar intoxicated, where she refused service to him. She saw Bennett leave and Bennett got into a car. Rosholt was worried he was going to drive away.
Rosholt described the vehicle as a gray Ford Focus with Minnesota plates of DEP434. The plate came back to a gray 2012 Ford Focus, listed to a Margaret Bennett, [DOB REDACTED]. While on the way to the call location, it was said that the suspect’s vehicle left westbound on W Michigan St. Officer McKee was able to locate a matching vehicle with Minnesota plates of DEP434 parked at the 27 West Liquor Store. Officer McKee got behind the vehicle and activated their emergency lights. The driver side door was open, and the driver had their legs sitting on the ground, hanging out of the car.
Officer McKee made contact with the sole occupant of the vehicle. The male suspect was sitting in the driver seat and the keys to the vehicle were on his lap. The driver was identified as MARK STEVEN BENNETT, [DOB REDACTED], the Defendant herein, and was observed to have breath with an odor of an alcoholic beverage, bloodshot watery eyes, slurred speech, and failed to correctly perform field sobriety tests, including failing a PBT with a result of 0.206 BrAC. The Defendant was placed under arrest for driving/operating/being in physical control of a motor vehicle while under the influence of alcohol.
Upon being read the Breath Test Advisory and after being advised of the right to speak to an attorney, the Defendant consented to take the offered breath test. The Defendant's alcohol concentration was 0.21 g/210L at 3:48 P.M.
