The reason for the requested removal was business staff’s belief that this individual had stolen from the business the day prior. Officer arrived on scene and located the individual, who was identified as John Thomas Kleveter, [DOB REDACTED] (Defendant). Officer explained that the business wanted Defendant removed and trespassed. Officer escorted Defendant out of the business. Defendant was compliant. While this was occurring, Officer learned that Defendant had two pending warrants for his arrest.
Officer then arrested Defendant. Officer noticed that Defendant was grasping something in one of his hands. Officer requested that Defendant release what he was grasping. Defendant resisted this. Officer eventually was able to open Defendant’s hand and located a baggie with what appeared to be a controlled substance inside of it. Defendant admitted it was a controlled substance and told Officer he intended to sell it. Defendant was then transported to the Winona County Jail. The suspected controlled substance was later tested and weighed.
The suspected controlled substance tested presumptively positive as cocaine. The cocaine weighed approximately 0.5 grams. PLEASE TAKE NOTICE: Pursuant to Minn.
