HEIDI JEAN STOTTLER [DOB REDACTED] and JUSTIN LEE BIEGANOWSKI [DOB REDACTED], defendants herein, were the only individuals located in the residence at the time the warrant was executed. Upon entry officers located STOTTLER in the kitchen area of the residence. She was detained by officers. BIEGANOWSKI was located in a southeast bedroom and was detained. After knocking and announcing but prior to entry officers observed BIEGANOWSKI to be in the north office room making furtive movements and digging around.
A search of the residence resulted in the discovery of a Louis Vuitton purse located on the living room floor near the couch that contained four plastic baggies that each contained a crystal substance that field tested positive for the presence of methamphetamine. The total unpackaged weight of the methamphetamine in the purse was 37.48 grams. The purse also contained a US passport in STOTTLER'S name. When officers initially entered the north office room where BIEGANOWSKI had been seen prior to entry, they noted an overwhelming chemical smell and cloud of smoke in the room consistent with someone having very recently smoked methamphetamine.
The north office room contained tools and a disassembled snow blower. In that room officers located a pink purse that contained a clear plastic baggie that held a white crystal substance that field tested positive for the presence of methamphetamine and weighed 11.47 grams without packaging. The purse also contained a driver's license and debit cards in STOTTLER'S name. Two baggies containing a white crystal substance that field tested positive for the presence of methamphetamine and weighed 4.56 and 4.40 grams respectively and without packaging were also located under some clothes on the floor in the north office room in the area where BIEGANOWSKI had been observed prior to entry.
A bubble pipe used to consume methamphetamine and a clear plastic baggie containing a substance that field tested positive for the presence of methamphetamine and weighed 0.62 grams without packaging were located in a potted plant in the bedroom where BIEGANOWSKI was located after entry. Multiple items used to consume controlled substances were also located in the room. BIEGANOWSKI provided a Mirandized statement in which he admitted that he works on small engines in the room with the snow blower and tools, that he had knowledge of methamphetamine located in the north office room, that he had smoked methamphetamine the previous day and that he had purchased under a half ounce of methamphetamine that would be located in the residence four days prior.
STOTTLER provided a Mirandized statement in which she admitted that she had used methamphetamine two weeks prior, that she shares a bedroom with BIEGANOWSKI, that they are the only people living in the residence, that she has access to all the rooms in the residence. The total amount of methamphetamine located in the shared residence was 58.53 grams without packaging. BIEGANOWSKI has a prior conviction for 2nd Degree Sale of a Controlled Substance from 2015.
