On or about September 30, 2025, Minneapolis police responded to report of a criminal sexual conduct that happened approximately one hour prior to calling. Minneapolis police arrived and made contact with the reporting party, "Witness 1", and her friend," Victim" herein. The victim [NAME REDACTED] on both sides of her neck. She told police she was texting a guy she knew by the name of "Nuni," later identified as Devon Xavier Thomas [DOB REDACTED], "Defendant" herein. She said defendant has been around her building and is friends with her neighbor.
She said defendant texted her to hang out and said he wanted to "f*** her." The victim [NAME REDACTED] told him no several times before she invited him over and she didn't want that to happen, but he could come over. She said he came over and they smoked and had drinks in her living room. Defendant said he was going have sex with her and the victim told him no several times. Defendant then carried the victim to her bed and put his fingers inside her vagina. She told him no and he then penetrated her vagina with his penis.
At one point, while she was saying no, defendant strangled her with one hand and said, "I'm not done with you yet." The victim said while being strangled she could not breathe. When he left, the victim called Witness 1, who then called 911. The victim was transported to the hospital for a sexual assault exam. Victim's swabs from the exam were taken to the Bureau of Criminal Apprehension (“BCA”) for DNA testing. A DNA profile was obtained and searched through the Minnesota Convicted Offender DNA Database.
The DNA profile matched Defendant's DNA profile in the database. The victim also provided police with defendant's phone number. Police checked its database and confirmed the phone number is listed to defendant. Defendant poses a threat to public safety. The State respectfully requests a warrant issued with this complaint.
