On March 8, 2025, Minneapolis police officers met with an adult female, Victim, regarding a sexual assault that occurred a few months prior, around December 19, 2024. Victim [NAME REDACTED] at the bars in Minneapolis that night when her friend called and invited her over to another friend’s house. The other friend, later identified as EZEQUIEL ALEJANDRO CRUZ-LOPEZ [DOB REDACTED], hereinafter “Defendant,” lived in an apartment on the 1300 block of Spruce Place, in Minneapolis, Hennepin County, Minnesota.
Victim [NAME REDACTED] went to Defendant’s apartment and saw they were having a small gathering with several people. Victim had numerous drinks prior to arriving at the apartment. Victim [NAME REDACTED], Defendant gave her a drug she believed was MDMA, but she was not sure. Victim stated after she took the drug, she started feeling very impaired and had trouble balancing. Victim called or texted several friends to come pick her up. She remembers her friends came, but Defendant argued with her friends and would not let her leave.
Victim [NAME REDACTED] went to sleep at the apartment. Victim and an unidentified male slept on the couch. Victim’s friend slept on a chair and Defendant slept in his bedroom. Victim stated that a short time later, she woke up and realized the unidentified male was rubbing her vagina over her yoga pants. Victim stated she felt paralyzed and was very afraid. She then saw Defendant standing near the bedroom door. Defendant came over to her and walked her to his bedroom. Victim stated she felt very weak and could barely get off the couch.
She remembers ending up on Defendant’s bed curled up in the fetal position. Defendant pulled her pants and underwear down and tried to push his penis into her vagina but could not penetrate her vagina because of the angle she was laying. Defendant then penetrated her vagina with his fingers. He again tried to penetrate her vagina with his penis while grabbing her breasts. Victim [NAME REDACTED] in the fetal position to prevent Defendant from penetrating her vagina with his penis, but she eventually passed out while this was happening.
Victim [NAME REDACTED] had sexual intercourse with her, but when she woke up, her vagina was sore and she had several bruises on her thighs. Victim [NAME REDACTED] did not consent to any sexual activity at the apartment, nor did she have the capacity to do so.
