10 AM, dispatch aired a report of a neighborhood disturbance. The caller identified stated that there was a vehicle playing loud music near the address of [ADDRESS REDACTED] in Spicer, Kandiyohi County, Minnesota. Deputy Bilky of the Kandiyohi County Sheriff’s office arrived in the area at approximately 1:21 AM. The deputy observed a white car parked at the park on Beach Street. She parked her squad car on the side of the street and approached the car on foot. She approached on the vehicle’s passenger side.
Her flashlight illuminated the rear passenger seat area where she saw an individual sitting. The deputy knocked on the window and the rear passenger opened the door. As the rear passenger opened the door, a smell of marijuana and a billow of smoke came from inside the vehicle. Deputy Bilky observed two other passengers in the vehicle, one behind the driver’s seat and the other in the front passenger’s seat. The rear passenger was identified from his Minnesota driver’s license as KHAIRE MOHAMED HOUSSEIN. The other passengers provided names as well.
HOUSSEIN indicated that they were just hanging out listening to music. He said he drove but switched seats with YAHYE MAKI MOHAMOUD due to his height. HOUSSEIN admitted to smoking marijuana after they got to the park. HOUSSEIN said he did not plan on driving until the marijuana wore off. He said that they smoked everything before they arrived. Deputy Bilky began searching the vehicle at approximately 1:34 AM. Deputy Bilky started at the front passenger seat and continued to the rear area behind the driver.
She then moved to the rear passenger side where she observed a red colored handgun on the rear passenger floor where HOUSSEIN was seated. Deputy Bilky cleared the handgun and gave it to Deputy Moist. Deputy Bilky continued the search. She located a clear plastic bag inside a black looking handbag with a green leafy substance. All three individuals were detained. Deputy Bilky gave the Miranda Warning to HOUSSEIN and asked to speak to him. HOUSSEIN stated that he understood his rights and told Deputy Bilky the following.
HOUSSEIN stated that he thought the gun was his brother’s and when he was sitting in the squad car he understood what was happening and just needed some time. He said, “To be honest with you the whole time I thought it had gotten left.” This was regarding the gun. HOUSSEIN said he came from work. He works at 4th Avenue Homes and has a client there by himself. That client is autistic and nonverbal. HOUSSEIN said that he doesn’t know who owns the gun. HOUSSEIN said that he has been using his brother’s car for a while and it is his car that he usually drives.
HOUSSEIN said he was in Willmar at around 3:00 PM hanging out. He said that they had all then separated. HOUSSEIN said that he later met the other two passengers after work. He said that they weren’t supposed to leave the 4th Avenue home but they did leave and went to the park. He said that he was gone from the 4th Avenue home for about an hour.
