On November 29, 2025, a ICAC data tip was received by the Rochester Police Department, which contained a cybertip with suspected “child sexual abuse material” (CSAM) that was uploaded to X on September 3, 2025. That tip related to 6 CSAM videos being uploaded. X provided a username of “zluef**” with a gmail email accounts and IP addresses associated with the account that uploaded the CSAM videos. The videos were verified to contain CSAM and were of nude female children between the ages of 1-16 years old engaging in sexual acts with others or exposing their vagina or buttocks in a lewd and lascivious matter.
The IP address associated with the tip was registered to an in NW Rochester, MN, Olmsted County. Through investigation it was learned that at least three people resided in that residence. Witness 1 (adult male identified in police reports) was the target of the investigation. On January 27, 2026, a search warrant for the NW address was executed. Witness 1 confirmed his internet provided but denied knowing anything about the email addresses that were associated with the tip. Witness 1 said he used, X, but not with the username that was provided in the tip.
He stated that along with his parents, two brothers also lived in the residence. Witness 1 acknowledged that he has seen CSAM on X, but denied uploading any images to X. A preview was conducted on Witness 1’s cellphone and there were no immediate signs of CSAM on the devices. Officers searched the NW residence, and DIEGO LABASTIDA [DOB REDACTED] answered the door. Labastida began retreating into the house and was stopped by an officer. Labastida offered his device to officers and told officers where his phone was.
Det. Neumann asked to talk to Labastida and Labastida said he would talk but wanted to do so privately. Labastida were read the Miranda advisory, and he agreed to give a statement. Labastida said that he had an idea why officers were at his house. He admitted that he does have an X account on both of his phones and admitted to the email accounts and usernames associated with the cybertips. Labastida said he has been viewing CSAM for a few years. Labastida has sent CSAM to other people using his cellphone.
He last sent CSAM the week prior, but views CSAM daily. One video that was uploaded to X was of a 3–5-year-old nude female performing oral sex on a nude adult male. Another video was of a 1–3-year-old nude female with a adult male masturbating in front of the child’s vagina. 2 ••-CR-••-•••• Filed in District Court State of Minnesota 1/29/2026 PLEASE TAKE NOTICE: YOU MUST APPEAR FOR EVERY COURT HEARING REGARDING THIS CASE.
