Cloud Police Department were dispatched to a residence on 27th Street SE in the City of St. Cloud, Sherburne County, Minnesota, regarding a gunshot complaint. Multiple callers reported hearing gunshots and arguing. Officers arrived on scene and located multiple parties screaming. One of the individuals was identified as Diamond Nicole Brown, [DOB REDACTED], the Defendant herein. Defendant initially gave a statement to law enforcement advising that she got into an argument with her brother and that she heard no gunshots.
Defendant later acknowledged discharging her pistol after yelling at her brother who was trying to enter a vehicle. She described it as a “warning shot” that she fired into the air. Defendant identified it was a single round fired, and that she disarmed her firearm and placed the firearm in her closet after firing. Officers located the firearm and seized it. The firearm was identified as a Taurus 9 mm handgun. There was a magazine sitting next to the firearm, and one round in the chamber. Defendant admitted to drinking alcohol and showed signs of impairment, including slurred speech and the odor of alcohol.
She provided a Preliminary Breath Test which showed the presence of alcohol. Surveillance video was obtained from the apartment complex showing the incident. Officer Richter observed the video which shows Defendant and a male party engaged in a physical fight. The male party entered a vehicle from the front passenger side and appeared to assault the female driver. Defendant then came back into the video image with a firearm in her right hand and fired a round straight up into the air. Defendant then approached the vehicle and fired a second round into the air, which had the result of people exiting the vehicle.
The male was located and interviewed. He declined that anything happened regarding an assault or with a firearm. PLEASE TAKE NOTICE: Pursuant to Minn. Stat. 609.49, intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
