In March 2026, Carver County Sheriff's Detective Weber was conducting an undercover child solicitation operation utilizing social media platforms and online chat-based applications. An undercover profile (hereinafter "UC") was created utilizing photographs of a young-looking female and the name “Shelby”. On March 5, 2026, the UC profile received a message on Reddit from an individual, later identified as JOSE ANTONIO GUTIERREZ, [DOB REDACTED], the defendant herein. After the UC told the defendant she was 15-years-old, the defendant asked if she wanted to meet up and stated the UC being under 18 was not an issue for him.

On March 9 and 10, 2026, the defendant asked the UC if she ever sneaks out and told the UC that he was "down" if she wanted to do something in his car. On March 11, 2026, the defendant sent the UC the following messages: “You know what breeding is"; "Breeding is just a game I like to play"; "One of us in on top and the other person has to get out from under them because they're pinning them down"; "Keep it a secret from your friends tho"; "Well we bump our hips into each other while we're doing it"; "So you would lay flat on the floor and I would lift your legs up and hold your wrists down"; "And you have to get out from under me while I'm bumping my hips into you"; "I've heard some people do with no clothes"; "And they're bumping against their own skin"; "Do you wanna try something like that?"; "I think they also do one method where the guy goes inside the girl"; "Did you wanna try that one too?" The defendant then asked the UC if she had ever had sex before.

The defendant also sent the UC several pornographic images, including "ForcedBreedingHentai". The defendant also sent the UC the following messages: "Oh is that the bed we're gonna breed on when you sneak me in?"; "Take a pic of you practicing your position"; "On your back legs up". On March 12, 2026, the defendant sent the UC a pornographic image. On March 16, 2026, the defendant asked the UC if she could sneak out on Thursday. The defendant also sent the UC the following messages: "Oh wait rq (real quick) can you show me your bedsheets"; "I wanna make sure I won't stain them"; "During the breeding game"; "I guess we can wrap you up in a blanket and use you like an onahole"; "Thursday you gonna get filled up"; "Would your mom get mad if she came back with me inside of you?"; "Lol can you do missionary with your plushy"; "It's a practice tool for the breeding game". An "onahole" is an artificial vagina designed for use in masturbation.

With regards to the "onahole" the defendant said "Well you're gonna love it when I crush your womb like I'm using one" On March 17, 2026, the defendant sent several pornographic images to the UC including images titled "rape hentai" and "ForcedBreedingHentai".: 4 10-CR-26-230 Filed in District Court State of Minnesota 3/20/2026 On March 18, 2026, the defendant sent the UC the following messages: “II'm[sic] gonna use you in the car when you come to the park"; "So I'll keep the door unlocked and I'll have it out for you"; "You getting wet thinking about it huh"; "Where do you want me to shoot my baby batter"; "You wanna do it on your mom's bed?"; Bet you're thinking about how imma be all up inside you while sitting next to her"; "How wet is it"; "Do you ever play with it". The defendant also sent the UC several pornographic images.
