Probable Cause
On 3/28/2026 An officer with the Anoka PD was on routine patrol near West Main St in the City of Anoka, in the County of Anoka. He observed a vehicle fail to yield right of way when entering a roadway, and fail to use its blinker when it did. The vehicle was also hugging the double yellow line. The Officer initiated a traffic stop. The vehicle initially game to a stop, but then took off at a high rate of speed. The erratic driving and high rate of speed lead the Officer to continue pursuit of the vehicle and he eventually disabled the vehicle with two PIT maneuvers, boxing it in.
When additional officers arrived, the driver was taken into custody and identified as Michelle Lee Benson [DOB REDACTED], herein Defendant. The Defendant emitted an odor of alcohol, had watery eyes, slurred speech and poor balance. Upon being read the breath test advisory, Defendant stated she wanted an attorney. At the Anoka County Police Department, she was provided time with an Attorney, and refused to take the test. She was advised of the consequences of failing to do so, and still refused. Defendant was previously convicted of DWIs in 02-CR-23-5465 (2023), 27-CR-92-049781 (1992).
