On 11/05/2025 at approximately 6:42P.M. Law enforcement conducted a traffic stop at Business 1. An individual Cody Blue [DOB REDACTED] who was later recognized from prior contacts. Who was known to have a “revoked” driver status. Blue walked to her truck bearing the MN license plate [PLATE REDACTED] and got into the driver’s seat. Law enforcement observed two passengers in the vehicle as well. The front seat passenger was recognized to be Cody Ness [DOB REDACTED] and had active warrants out for his arrest.
Office Maxwell Strong approached the passenger side of the vehicle and requested Ness to exit the vehicle. Ness immediately locked his passenger door to prevent Officer Strong from opening it. The vehicle then began rolling slowly and stopped. A Pink bubble pipe was observed with burnt residue located in the center cup holder. Ness then excited the vehicle and was placed under arrest. Ness stated that he had used methamphetamine earlier in the day. Officer Strong spoke with Cody Blue and upon immediate conduct with Blue Officer Strong observed Blue’s eyes to be bloodshot and glassy.
Blue stated her main drug of choice is opioids and used her prescription medication earlier in the day. Blue performed SFTSs. Blues displayed nystagmus and did not perform well on the SFTSs. Blue was arrested and transported to the BEC Jail and completed further evaluation with Drug Recognition Expert (DRE) Deputy Schnorenberg. Deputy Schnorenberg believed that Blue was impaired on a mixture of Cannabis and a Narcotic Analgesic. A search warrant for Blue’s blood or urine was completed and signed by the Honorable Judge Stephen Ferrazzano II. A loaded syringe was found in Blue’s red handbag.
The syringe contained a brownish liquid substance. Blue’s CCH showed that she was convicted of a DWI in 2017 in South Dakota, and a 5th Degree substance possession charge in 2021. Officers Cory Keane, and Officer Rutz Keaton conducted a probable cause search of the vehicle and observed a green leafy substance that appeared to be marijuana in plain view in the vehicle which was not in its original packaging. Law enforcement searched the vehicle, and several items of note were found. A clear plastic baggie which was believed to be marijuana., a gray lunchbox near the center of the seat in the rear vehicle contained several prescription medication bottles bearing the name Cody Ness containing a green leafy substance consistent with marijuana.
A prescription bottle with the name ripped off containing a white, crystalline substance NIK tested positive for methamphetamine, lighters, pipes containing burnt residue, and loose omeprazole pills. After the search Officer Keaton Rutz spoke with Cody Ness who was handcuffed in the backseat of Officer Strong’s squad car. Ness was read his Miranda Warning and Ness advised he would speak with Officer Keaton. Ness advised he did not know who the meth found in the vehicle belonged to. He had not seen either of the two other passengers use or have possession of meth.
