52 P.M., Officer Heather Gerads of the Willmar Police Department was dispatched to a home in the 1000 block of Gorton Avenue NW in Willmar, Kandiyohi County, Minnesota regarding a domestic assault. Adult Female A reported that NICOLAS CRUZ ANDRES [DOB REDACTED] hit her leaving a lump on her head and a nose bleed. CRUZ ANDRES is a family or household member of Adult Female A. Officer Gerads located CRUZ ANDRES sitting on the steps on the south side of the residence. Officer Gerads asked if his name was NICOLAS, to which he said yes.
When asked what was going on, CRUZ ANDRES said “I’m guilty.” Officer Gerads asked him what he was guilty of, and CRUZ ANDRES put his arms out in front of him, as if he wanted to be placed in handcuffs. When asked again, CRUZ ANDRES put his arms out in front of him again and said, “I’m guilty.” CRUZ ANDRES stood up and put his hands behind his back, as if he wanted the handcuffs on him again. Officer Gerads spoke with Adult Female A. Officer Gerads observed a large lump above her left eyebrow, which also appeared to be bruised, as well as redness and swelling on her left cheek.
Adult Female A was taken to the hospital. Adult Female A stated that CRUZ ANDRES came home early. When he got home, she thought that he had been drinking and asked why he was drunk. CRUZ ANDRES punched her with a closed fist by her left eyebrow, left cheek, nose, chin, and both arms. Officer Gerads observed bruising on her right arm, as well as a small scrape on her left elbow. Adult Female A believed the scrape was from CRUZ ANDRES’ fingernails. Adult Female A also had bruising and a cut on the inside of her lower lip.
Adult Female A also explained that CRUZ ANDRES grabbed her with one hand around her neck and threw her on the couch. During that time, she could not breathe and felt as if she needed to vomit, but she couldn’t due to him having his hand around her throat. Adult Female A also advised that after CRUZ ANDRES took his hand off her throat, she felt dizzy. Adult Female’s A throat felt dry. When asked if it was sore, Adult Female A stated that her whole body hurt. She believed that CRUZ ANDRES hit her around six times, including her face and her arms.
