The Complainant having reviewed the applicable reports believes the following facts to be true: that on November 16, 2025 at approximately 10:20 P.M. A University of Minnesota police officer was patroling near Como Avenue and Eustis Street in the City of Saint Paul, Ramsey County when he observed a vehicle (MN plate RTM247) traveling north on Eustis which was weaving and speeding (40 mph in a posted 30 zone). They stopped the vehicle and identified the driver as Michael John ACKERMAN-ENG, [DOB REDACTED], MN DL # G597089746521, Defendant herein.
Defendant had an odor of alcohol on his breath as they spoke, and his eyes were bloodshot and glossy and his speech was slurred. An open case of beer was in the car within his reach as well as an unopened can in the door. Defendant performed poorly on multiple field sobriety tests, so he was placed under arrest for DWI. Defendant was transported to the police station and a rights advisory was read to him. After taking over a half-hour of attorney time, Defendant was asked if he would take a breath test, and four times he gave no answer.
As his behavior was about to be considered a refusal, he agreed the fifth time he was asked. However, when given the chance to take the test, Defendant attempted to evade it by not creating a seal around the blowing tube, not blowing enough air into the machine, and finally putting his fingers down his throat in an effort to belch, vomit or otherwise defeat the test. At this point, his behavior became a refusal to take the test. Defendant has a gross misdemeanor conviction for DWI in 2019.
