That on or about August 16, 2025 at approximately 3:50 A.M., Lt. Isaacson of the Minnesota State Patrol was driving on Interstate 394 from Highway 100 in St. Louis Park, Hennepin County, Minnesota when he observed a vehicle bearing Minnesota license plate [PLATE REDACTED] that was pulled off on the side of the road. Lt. Isaacman drove past the vehicle and observed the driver appeared to be slumped over. Lt. Isaacman pulled up behind the vehicle and approached the driver’s side of the vehicle. Lt. Isaacman observed the driver slumped over holding a cell phone.
The vehicle’s ignition keys were sitting on the driver’s right thigh. The driver had a yellow event type wristband on his arm. Lt. Isaacman knocked on the window several times before the male woke up. The male appeared lethargic and confused. Lt. Isaacman opened the door of the vehicle and noticed the odor of alcohol. Trooper Ginter arrived on scene and identified the male as ERICK JOEL MALDONADO DAVIS (“Defendant” herein). Trooper Ginter could smell the strong odor of a consumed alcoholic beverage coming from Defendant’s person.
Defendant’s eyes were bloodshot and watery, and he was unsteady on his feet. Trooper Ginter administered a preliminary breath test sample to Defendant, which revealed a reading of 0.158. Trooper Ginter placed Defendant under arrest and utilized a language line to read Defendant the Breath Test Advisory. Defendant stated he understood and declined to speak with an attorney. Defendant refused to make a decision about testing, and Trooper Ginter deemed his indecision a refusal. At present, Defendant is not in custody.
