That your complainant is a peace officer employed by the Rochester Police Department who was advised of the following by a law enforcement officer with that agency, known to your complainant to be truthful and reliable and who is hereinafter referred to as officer: On 11/5/2025, at approximately 5:36 P.M., while in the City of Rochester, Olmsted County, State of Minnesota, a Rochester Police responded to a DWI investigation after an accident had occurred, and one of the drivers had left the scene.
The driver of the other vehicle described the driver that had left the scene. The officer observed the suspect vehicle, Minnesota license, RZZ656. Near the location the of the accident the officer observed a male and a female. The officer explained the situation to the male, who is identified in reports, and asked if he knew the female, to which he replied that he did not. The officer then began to speak with the female, later identified as Stephanie Garcia, [DOB REDACTED], hereinafter "Defendant", by her driver's license.
Eventually the defendant admitted to to driving the vehicle. The officer observed an odor of an alcoholic beverage coming from the defendant as she spoke, as well as an unsteady gait, and bloodshot and watery eyes. Per the defendant, the accident occurred as she was pulling into the apartment complex. The defendant failed standardized field sobriety tests, to include a PBT with a result of 0.173. The Defendant was placed under arrest for driving/operating/being in physical control of a motor vehicle while under the influence of alcohol.
Upon being read the Breath Test Advisory at 7:08 P.M., and after being advised of the right to speak to an attorney, the defendant consented to take the offered breath test. The defendant’s alcohol concentration was 0.16 at 7:20 P.M. PLEASE TAKE NOTICE: YOU MUST APPEAR FOR EVERY COURT HEARING REGARDING THIS CASE. FAILURE TO APPEAR FOR COURT IS A CRIMINAL OFFENSE AND MAY RESULT IN ADDITIONAL CRIMINAL CHARGES BEING IMPOSED AND PUNISHED AS PROVIDED IN MINNESOTA STATUTES SECTION 609.49.
