That on November 10, 2025, at approximately 0041 hours, Officers T. J. And N. K., Minneapolis Police, observed a vehicle (MT Lic.#458617B, 2004 Dodge Ram 1500) four to five car lengths from the intersection of 28th and Chicago Avenue, Minneapolis, Hennepin County, Minnesota. Officers pulled up to the vehicle and observed the driver, Defendant herein, Errol Kenneth Higdon, [DOB REDACTED], slumped behind the wheel of the running vehicle. Officers knocked on the window and Defendant woke up and immediately got out of the vehicle which then began to move as it was still in drive.
Officers stopped the vehicle and placed it into park. Defendant admitted consuming alcoholic beverages and Trooper A. F., Minnesota State Patrol, responded to assist. Trp. A. F. Noted that Defendant smelled of an alcoholic beverage, had bloodshot/watery eyes, had slurred speech, and almost fell over as he exited the squad. Defendant failed to follow instructions during field sobriety tests but provided a breath sample for the preliminary breath test which showed his alcohol level to be 0.210. Defendant was placed under arrest and was read the Minnesota Breath Test Advisory after which he refused to provide a breath sample stating, “because f*** you.
