On November 3, 2025, at approximately 11:08 P.M., Sergeant Andrew Lehmkuhl with the Waite Park Police Department was on routine patrol in his squad vehicle. At that time, he observed a silver minivan approach him traveling westbound on County Road 138 just east of County Road 121 in Waite Park, Minnesota. The vehicle appeared to have its high beam headlights on in violation of the law. Sergeant Lehmkuhl turned around to initiate a traffic stop on the vehicle. Sergeant Lehmkuhl followed the vehicle north on County Road 121 into St. Joseph, Minnesota.
Sergeant Lehmkuhl activated his squad vehicle's emergency lights in an attempt to stop the vehicle. The vehicle then turned around and approached Sergeant Lehmkuhl's vehicle head-on so that Sergeant Lehmkuhl had to move his vehicle to the right to avoid the suspect vehicle. The vehicle then drove away at a high rate of speed. The vehicle proceeded southbound on County Road 121 and then eastbound on County Road 138 into the city of Waite Park, county of Stearns, state of Minnesota. Sergeant Lehmkuhl continued to pursue the vehicle with his emergency lights activated, but it did not stop.
The vehicle would toggle its lights off and then back on. Additional police squad vehicles joined the pursuit and followed the suspect vehicle. Eventually, the vehicle stopped at a residence on the 100 block of Belmar Drive in Waite Park, Minnesota. Sergeant Lehmkuhl directed the driver to exit the vehicle and the driver responded by saying, "Make me." The driver eventually exited the vehicle and was identified as LUIS DAVID GUZMAN VASQUEZ, [DOB REDACTED], the defendant herein. In a Mirandized interview, the defendant admitted that he knew police officers were trying to pull him over and that he was supposed to stop.
The defendant stated that he did not stop because he does not trust people and that he turned his lights on and off to try to get away from the police. Complainant has reason to believe and does believe that all of the above information is true and correct. The above facts constitute your complainant's basis for believing that the above-named defendant, on or about the 3rd day of November, 2025, in the city of Waite Park, county of Stearns, state of Minnesota, committed the offense described herein.
