On January 19, 2026, at approximately 3:01 P.M., officers of the Austin Police Department were dispatched to Walmart located at 1000 18th Avenue NW in the City of Austin, County of Mower, on a report of a domestic assault. Prior to arrival, dispatch advised that the suspect, KATHLEEN MARIE GUY, DOB/082192, the defendant herein, had walked away from the scene and headed in the direction of Pizza Hut, and Victim A (an adult female) was in a 2006 Ford Freestyle (MN LIC/GDS979) by the Tidal Wave car wash.
Officer Thomas arrived and made contact with Victim A. Victim A was seated in the front passenger seat of the vehicle. Victim A and the defendant reside at the same address. Victim A stated that the defendant got mad at Victim A while they were in the car in the Walmart parking lot. Victim A said that the defendant started hitting the center console in the car and then reached over and hit Victim A in the arm twice. Victim A said the defendant then hit her in the chest and spit in her face. Victim A said that she yelled at the defendant to stop and did not hit back.
Officer Thomas then spoke with Witness 1 (an adult male). Witness 1 stated that he was working at Tidal Wave when he saw two people fighting in the Ford. Witness 1 said that the female who left (the defendant) was on top of Victim A. Witness 1 stated that the defendant was the aggressor. Officer Thomas then spoke with Witness 2 (an adult female). Witness 2 was a passenger in the suspect's car and was seated behind the driver’s seat when the incident occurred. Witness 2 stated that the defendant got mad and started hitting the dash and center console before she hit Victim A. Witness 2 stated that the defendant was intentionally spitting on Victim A and yelling at her.
Witness 2 stated that after the incident was over, the defendant got out of the car and walked away. Officer Schuweiler went to Pizza Hut and made contact with the defendant. The defendant told Schuweiler that she and Victim A had been shopping at Marshall’s and were driving to Walmart area. She stated that Victim A told the defendant that she should “make signs” and stand on the street asking for money/handouts. The defendant stated that she told Victim A she did not want to do that, but Victim A continued to badger her about it.
The defendant stated that she told Victim A to get out of the car because of how she was treating her and that she was going to call her sister to come get the car. The defendant said Victim A then took her phone to prevent her from doing that. The defendant denied physically assaulting Victim A and denied intentionally spitting on her. The defendant was placed under arrest and transported to the Mower County Jail. A review of the defendant’s criminal history reflects prior convictions for Violate Domestic Abuse No Contact Order dated September 7, 2021 (Mower County District Court file ••-CR-••-••••) and Violate Domestic Abuse No Contact Order dated October 25, 2023 (Mower County District Court file 50-CR-22- 1346).
