On November 2, 2025, officers with the Rochester Police Department were in downtown Rochester, Olmsted County, MN at approximately 1:33 AM. Ofc. Fitzgerald noticed a commotion coming from the entry of Kathy's Pub. Ofc. Fitzgerald saw employees of the pub escorting a man out of the bar. This man, later identified as CLIFTON DEJOHN HUBBERT [DOB REDACTED], loudly proclaimed "I'm done" multiple times. He then abruptly punched Victim (an adult male) in the face. Ofc. Fitzgerald saw Victim's head strike the ground after Victim lost consciousness as a result of the strike.
Hubbert was immediately placed under arrest. During a search incident to arrest, two plastic bags containing suspected controlled substances were found on Hubbert's person. Those substances later tested presumptively positive for cocaine and fentanyl, and weighed a total of 1.22 grams, including packaging. Hubbert was transported to the Olmsted County Adult Detention Center. After being read a Miranda advisory, Hubbert explained that there was an altercation inside the pub. During the altercation, Victim slapped Hubbert multiple times and Hubbert punched him in response.
After those exchanges, Hubbert was removed from the bar, which is when he struck Victim in the face causing him to go unconscious. Hubbert admitted that he knew it was wrong and should not have done so. Hubbert also admitted to possessing controlled substances, noting that he gave a friend $100 for the cocaine.
