On October 4, 2025, at approximately 12:01 A.M., a trooper was dispatched to the area of Highway 62 under the Highway 55 bridge for a report of a motorcycle that was crashed on the side of the shoulder. This location is in the Ft. Snelling Territory in Hennepin County, Minnesota. Upon arrival, other officers were present with the driver of the motorcycle, RICK ALLEN GIBSON [DOB REDACTED], hereinafter “DEFENDANT.” The DEFENDANT told the trooper that the brakes had locked up on the motorcycle, and he had hit the curb before stopping it.
The DEFENDANT had a female passenger with him. The DEFENDANT said that he had come from his friend’s house and that he had last drank alcohol 3 hours prior. While speaking with the DEFENDANT, the trooper detected a strong odor of an alcohol beverage emanating from him. The trooper also observed the DEFENDANT to have bloodshot, watery eyes. The trooper performed Standard Field Sobriety Tests (SFST) on the DEFENDANT in order to ensure that he was safe to drive. During the Horizontal Gaze Nystagmus test, the trooper detected 6 out of 6 clues from the DEFENDANT. During the Walk and Turn test, the trooper observed 5 out 8 clues from the DEFENDANT. Additionally, during the One Leg Test, the trooper detected 4 clues from the DEFENDANT. The trooper then retrieved his Preliminary Breath Test device, in which the DEFENDANT refused to provide a sample.
The DEFENDANT was then placed under arrest for suspicion of Driving While Impaired. The motorcycle was towed by a towing company, and an inventory search was conducted on the motorcycle. The trooper located an open bottle of rum in the cooler in the left saddlebag of the motorcycle. The rum bottle was half empty. The DEFENDANT was transported to the Hennepin County Medical Center in order to be medically cleared due to the DEFENDANT being involved in a crash and to get a blood draw. At 1:23 A.M., the trooper obtained a blood draw warrant.
The trooper informed the DEFENDANT of the warrant and that refusal to submit would result in a crime. The DEFENDANT agreed to provide a sample. The blood draw was performed at 1:50 A.M. The DEFEENDANT was read his Miranda Rights, and he agreed to speak with the trooper. The DEFENDANT said that he was coming from his friend's house and that the brakes locked up on his motorcycle. The DEFENDANT said that he then laid the bike down due to the brakes locking up. The DEFENDANT told to the trooper he had consumed a “few” Rum and Cokes that evening and that he left his friend’s home around midnight.
The DEFENDANT was medically cleared and then transported to the Hennepin County Jail. The toxicology report performed by the Minnesota Bureau of Criminal Apprehension showed that the DEFENDANT had an ethyl alcohol concentration of 0.10. The DEFENDANT is not in custody. The state requests a summons for his appearance.
