On January 29, 2026, at 1345 hours, St. Paul police officers responded to Regions Hospital in St. Paul to take a criminal sexual conduct report. Officers met ER-S, a 24-year-old female. She reported that her estranged husband, Michael Rodriguez Alva, [DOB REDACTED], sexually assaulted her between midnight and 0200 hours on January 29, 2026, at her residence on the 700 block of Western, St. Paul, Ramsey County. She reported that she filed for divorce in November 2024. They share a child. He stays with his parents in Bloomington.
He was at her residence on January 29. He smelled of alcohol. He started an argument over their pending divorce. He threatened to kill her if she ever went back to Mexico. He said either he would kill her, or he would have somebody in Mexico kill her. He forced her into the living room and used his hands on her shoulders to force her to bend over. He then forced her into a spare room in the apartment. He removed her clothing. He forcefully penetrated her anus with a pink dildo. He then forced his hands into her anus.
She was telling him to stop. He put her feces into her mouth. He forced her into the shower to clean herself. He continued to penetrate her anus and vagina with his hand. He also forced his penis into her mouth. She was choking on his penis. He continued to threaten her throughout the sexual assault. He ejaculated into the bathtub. He then forced her into the bedroom where he penetrated her vagina with his penis. He ejaculated on the sheets. He took her keys and phone and followed her around the apartment all night.
She was able to leave the apartment around 0840 hour for work. She did not go to work. She drove herself to the hospital. A sexual assault nurse examiner documented a linear skin tear in her intergluteal cleft. ER-S said it was very painful, an 8 on a scale of 1-10. Also noted were several round red/purple bruises on her left anterior bicep, an area of erythema on the anterior deltoid, a linear red abrasion on the left anterior forearm, and red pinpoint abrasion on the left anterior forearm. Police executed a search warrant at the scene of the incident and recovered red fitted sheets with apparent stains on them.
They also photographed and collected a pink dildo in the kitchen. On February 2, 2026, officers arrested Alva at ER-S’s apartment. In a post-Miranda interview, he stated that he did not know why he was arrested. He acknowledged that he no longer lives with ER-S, as of two weeks ago. He said that he did not remember what happened on January 29. When asked if he was at the apartment on Western, he said that he would rather not answer.
