It was reported that a female spit on the vehicle and punched it. Upon arrival, Officer Allison Libor observed a 2024 silver Toyota Tacoma, bearing MN Lic LZX769. The driver, GKL stated that he had been driving eastbound on 181st Avenue NW near Twin Lakes Rd NW in the city of Elk River, Sherburne County, Minnesota. GKL stated that he changed lanes in front of a 2025 green Trailblazer, bearing MN Lic SGP507. The driver of the Trailblazer was upset with GKL. GKL stated that he drove quickly to get away from the driver of the Trailblazer, but the driver of the vehicle followed him.
GKL and the driver, later identified as Mariana Elena Martinez, [DOB REDACTED], hereinafter referred to as the defendant, got into a verbal altercation. During the altercation, the defendant spit on his rear passenger door and punched the side of his truck, directly below the window. GKL told Officer Libor that he would get an estimate for the damage. While Officer Libor was at the scene, she was approached by unrelated witnesses who observed the interaction and confirmed GKL’s version of the events.
Officer Libor contacted the defendant. The defendant said that GKL changed lanes in the middle of the intersection. She claimed that he slammed on the brakes on two occasions in the roadway. The defendant said that she pulled up next to GKL with her window down. She claimed that the GKL called her names. She said that she got out of her vehicle and approached GKL’s truck. She spit gum at his window and then punched his window. She claimed that her actions were in self defense. She claimed that she punched the truck when GKL began driving away.
Officer Libor later received an estimate for the damage to the vehicle. The estimate to repair the vehicle was for $2444.52. PLEASE TAKE NOTICE: Pursuant to Minn.
