Your Complainant is an Investigator for the Anoka County Sheriff’s Office and in such capacity makes this Complaint based upon the reports of Deputy Joshua Berggren, who your Complainant believes to be truthful and reliable. On November 1, 2025, at approximately 9:43 P.M., Deputy Joshua Berggren of the Anoka County Sheriff’s Office was on duty and received a dispatch report of a driving complaint of a vehicle that had driven across the complainant’s yard located at [ADDRESS REDACTED] NW, in the City of Andover, County of Anoka, State of Minnesota.
The complainant reported the suspect vehicle was now parked at a neighbor’s house. Upon arrival, Deputy Berggren located the suspect vehicle, Minnesota license plate [PLATE REDACTED], in the driveway at [ADDRESS REDACTED] NW. Deputy Berggren observed a female standing alone in the yard looking at the neighbors. Deputy Berggren spoke with the female subsequently identified as the defendant herein JENNIFER MICHELE HARMS, [DOB redacted]. The defendant stated that the vehicle belonged to her and that she missed her turn and just drove through the yard and parked at the residence.
Deputy Berggren observed the defendant was uneasy on her feet and observed the defendant’s eyes were glossy. The defendant stated, “maybe a little bit” when asked if she had consumed any alcohol. Deputy Berggren also detected the slight odor of an alcoholic beverage on the defendant. Deputy Berggren administered a series of standardized field sobriety tests to the defendant and observed signs of impairment. Deputy Berggren administered a PBT to the defendant which resulted in a reading of.255 alcohol concentration, a fail.
In the opinion of Deputy Berggren, the defendant was under the influence of alcohol. The defendant was placed under arrest and transported to the Anoka County Sheriff’s Office. Deputy Berggren read to the defendant the Minnesota Breath Test Advisory. The defendant stated that she understood the Advisory and wished to speak with an attorney. Attorney time was made available to the defendant from 10:20 P.M. Until 10:46 P.M. And the defendant was unable to reach an attorney. Deputy Berggren read the Advisory to the defendant on multiple occasions and at the end of her phone time, the defendant refused the breath test.
The defendant stated, “we have done it” when asked her reason for refusing the test. Deputy Berggren explained the PBT was not the official breath test and the defendant still refused the breath test. Deputy Berggren deemed this a test refusal. The above facts constitute the Complainant’s basis for believing that the above-named defendant on the 1st day of November 2025, in the City of Andover, County of Anoka, State of Minnesota, there did commit the above- named offense(s).
